PRIVACY AND COOKIES POLICY

In performance of the Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR), OMNIRES Spółka z ograniczoną odpowiedzialnością hereby adopts the Privacy and Cookies Policy presented below. The Policy is of informational character only. It does not serve as a source of rights and obligations for the Customers of OMNIRES Sp. z o.o., nor for the Users of the www.omnires.com website.

 

§ 1. Who is the Controller of your data?
 

Your personal data are controlled by: OMNIRES Spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office in Warsaw, at ul. Kleszczowa 18, 02-485 Warsaw, entered into the register of entrepreneurs, under the number KRS: 0000088578, NIP (Tax Identification Number): 5222626866, hereinafter referred to as the Controller.

 

§ 2. Data processing principles:
 

The Controller attaches great attention to respecting the rights of Internet users, with a particular emphasis placed on the protection of privacy rights. The privacy policy set forth below explains the procedures we comply with while collecting and processing personal data. When collecting and processing personal data, the Controller complies with all of the data processing principles set forth below and fulfills at least one of the conditions that need to be met for the purpose of processing personal data.

 

§ 3. Personal data processing principles:
 

1. Lawfulness, fairness and transparency;
2. Limitation of purpose;
3. Data minimization;
4. Correctness;
5. Storage limitation;
6. Integrity and confidentiality.

 

§ 4. Conditions of lawful processing of personal data:
 

1. The data subject has expressed their consent for the processing of their personal data for one or more specific purposes;
2. The processing is necessary for the performance of an agreement that the data subject is a party to, or for the purpose of taking specific activities upon request of the data subject, prior to the conclusion of such an agreement;
3. The processing of data is necessary in order to fulfill the Controller’s legal obligation;
4. The processing is necessary for the protection of vital interests of the data subject or of another natural person;
5. The processing is necessary for the performance of a task performed in the public interest or while exercising public authority vested in the Controller;
6. The processing is necessary for purposes arising from legitimate interests of the Controller or of a third party, with the exception of situations in which interests or fundamental rights and freedoms of the data subject that require the protection of personal data, in particular when the data subject is a child, prevail over such legitimate interests of the Controller or of a relevant third party.

 

When browsing our website, one or several cookie files may be saved on the user’s computer (or end device). Cookie files may be created by the Controller and by third parties with which the Controller cooperates. Please read the information presented below to learn more about cookie files and the manner in which these are used.

 

§ 5. What types of your data are collected?
 

1. The following types of data are collecting while registering on our website or while using contact or complaint forms: first and last name or company name, town or city, telephone number and e-mail address (and full mailing address when registering on the panel for professionals and when submitting complaints). You shall be also requested to consent to the processing of your personal data by the Controller.
2. Automated collection of data. During your visit on our website, data concerning your visit are automatically collected. These include, in particular: Your IP address, domain name, browser type, operating system type. For more information, please see the section concerned with cookie files.

 

§ 6. For what purpose and on what basis are your data processed?
 

Personal data obtained in connection with using the Controller’s website shall be processed for the following purposes:

1. Handling inquiries submitted via the contact form;
2. Performing sales-related processes;
3. Processing complaints;
4. Conducting marketing activities;
5. Taking security-related actions;
6. Archiving;
7. Pursuing legitimate interests of the Controller, consisting in promoting the Controller's services, managing such services, planning meetings and events, as well as improving the quality of services.

 

§ 7. Your personal data shall be processed based on the following:
 

1. The consent granted (Article 6(1)(a) GDPR);
2. The fact that the data are necessary for the performance of an agreement or for the taking of specific activities, upon your request, prior to the conclusion of such an agreement (Article 6(1)(b) GDPR);
3. The fact that your data are necessary to comply with a legal obligation vested in the Controller (Article 6(1)(c) GDPR);
4. The fact that your data are necessary for legitimate interests of the Controller (Article 6(1)(f) GDPR).

 

§ 8. Who will be the recipient of your data and where will they be transferred?
 

The list of recipients of the personal data processed by the Controller depends, in each case, on the scope of services the Customer takes advantage of. The list of personal data recipients may also depend on the Customer's consent or on legal regulations.

To a limited extent, the processing of personal data may be performed by the Controller's Partners, service providers, IT and hosting service providers, as well as by providers of accounting and bookkeeping, legal, courier, consulting and marketing services.

Your personal data shall not be transferred to third countries or international organizations.

 

§ 9. What are the periods over which your personal data will be processed?
 

The period of time over which your personal data will be processed depends on the purpose of processing. The period of time for which your personal data will be stored is calculated based of the following criteria:

1. The provisions of law that may require the Controller to process data for a specific period of time;
2. The period of time that is necessary to defend the Controller’s interests;
3. The period of time for the consent has been granted.

 

§ 10. What are your rights?
 

You have the right to:

1. Demand access to your personal data;
2. Data rectification;
3. Demand that incomplete personal data be supplemented, including by presenting an additional statement;
4. Erasure of personal data or restriction of processing;
5. Object to the continued processing of your personal data;
6. Portability of your personal data.

You also have the right to withdraw your consent at any time. The withdrawal of your consent shall not affect the lawfulness of the processing of your personal data performed based on the consent granted prior to its withdrawal.

In the event of any doubts concerning the correctness of the processing of your personal data by the Controller, you shall have the right to lodge a complaint with an applicable supervisory authority.

 

§11. What are the consequences of a failure to provide data?
 

The provision of data is voluntary. However, if the data is not provided, some of the website’s functionalities may not operate properly.

 

§ 12. How to obtain information about the processing of data?
 

Any correspondence in matters related to the processing of your personal data needs to be submitted to the Controller's address stated under item 1 of this Policy, with a note reading "Personal Data”, or by e-mail to the Controller's e-mail address of [email protected] . 

 

§ 13. Use of cookies:
 

Our website relies on cookies which are used to identify your browser while using our website. The cookies contain small amounts of text that may only be read by the website that has sent them. The information collected allows us to collect information on how often you visit our website and which of its elements you are interested in the most. The data obtained is used to better adapt the website to your needs, to facilitate its operation, as well as for statistical and advertising purposes. Cookie files cannot be used to infect the device with viruses or other malicious software (malware).

2. Cookie name: each cookie has a name that is unique on the website that has created it;

Cookies are used to store basic information that is required to correctly display the website content. The users of our website may cease to provide this information to our website at any time, by deleting the cookies our website has saved on their end devices. In order to do so, the settings of the web browser currently in use need to be changed. Our websites use the following types of cookie files:

__utmb	30 minutes from being created / updated	Used for determining new sessions / visits. The cookie file is created after the javascript library is executed and no existing __ utmb cookies exist. The cookie file is updated every time data are sent to Google Analytics.
__utmc	session	Not used in ga.js. Set for interoperability with urchin.js. Historically, this cookie operated in conjunction with the __utmb cookie, in order to determine whether the user was in a new session / visit.
__utmt	session	Used for reducing the request rate.
__utmz	10 minutes	Stores the traffic source or campaign that explains how the user reached your site. The cookie is created when the javascript library executes and is updated every time data is sent to Google Analytics.
_ga	6 months from being created / updated	Used for distinguishing users.
_gat	1 minute	Used for reducing the request rate. If Google Analytics is implemented via the Google tag manager, this cookie file will be named _dc_gtm_ _dc_gtm_<property-id>.
_gid	24 hours	Used for distinguishing users.
counter[*]	24 hours	Visit counter.
page_*	session	For pagination purposes.
cookiesPolicyDismissed	30 years	Information about the cookie policy.
sid	session	Session ID.

 

§ 14. How do we protect your personal data?
 

Our databases are protected against access by third parties. The data processed are secured by appropriate technical or organizational measures.

 

§ 15. Amendments to our Privacy Policy
 

We reserve the right to amend this Privacy Policy by publishing a new privacy policy on our website. Once such an amendment has been introduced, the Privacy Policy shall be published on the website, with a new date.

This version of the Privacy Policy has been in effect since 1 September 2019.
